Terms of Service
The agreement between you and ELDOVISA LLC. Written to be read, not to be skipped.
These Terms of Service (the “Terms”) govern your use of the ELDOVISA website at eldovisa.my and any service you purchase from us. By requesting a quotation, accepting a quotation, or using our services, you agree to these Terms. Please read them before you pay for anything.
1. Who we are
The services described on this website are provided by ELDOVISA LLC (“ELDOVISA”, “we”, “us”), a company registered under number 981933659 with its registered office at 8206 Louisiana Blvd NE, Suite A, Albuquerque, NM 87113, USA. You can reach us at info@eldovisa.my or on +44 7513 951182.
In these Terms, “you” means the person or organisation purchasing services, and “traveller” means the individual the services relate to, where these differ.
2. What we do and what we do not do
2.1 What we provide
ELDOVISA provides commercial travel-arrangement and administrative-preparation services. Depending on what you purchase, this may include:
- assessing your eligibility for a particular visa or entry route against publicly published criteria;
- preparing a document checklist specific to your nationality, destination and travel purpose;
- completing application forms using information you supply, and reviewing your documents before submission;
- submitting an application through the appropriate official channel on your behalf;
- monitoring application status and communicating updates to you;
- arranging flights, accommodation, ground transport, tours and related travel services.
2.2 What we are not
This is the most important clause in these Terms and we state it without qualification:
- ELDOVISA is not a government department, embassy, consulate, immigration authority or officially appointed agent of any of them;
- we do not issue, grant, approve or expedite visas, permits or entry clearances;
- we cannot influence, predict or guarantee the outcome of any application;
- we do not provide legal or immigration-law advice. Where a matter requires a licensed professional, we will say so and, where possible, refer you to one;
- we are not an insurer, an airline, a hotel or a tour operator. Where those services form part of your arrangements, we act as an intermediary between you and the supplier.
Any information we give about visa requirements reflects our understanding of the position at the time it is given. Immigration rules can change without notice and at the discretion of the relevant authority.
3. Your obligations
You agree that:
- all information and documents you provide are true, accurate, complete and lawfully yours to supply;
- you will disclose any previous visa refusal, overstay, deportation or immigration-related conviction relevant to your application. Non-disclosure is a common cause of refusal and is your responsibility, not ours;
- you hold a valid passport with sufficient remaining validity for your destination;
- you will supply requested documents promptly. Delays caused by outstanding documents extend timelines and are not our responsibility;
- you are at least 18 years of age, or are a parent or legal guardian applying on behalf of a minor;
- you will not ask us to submit false, altered or fraudulent information. We will refuse, terminate the engagement and retain fees for work already performed.
4. Fees, quotations and payment
4.1 Quotations
Because requirements vary by nationality, destination, visa category and urgency, we quote per case rather than publishing a single price list. Before any payment is taken you receive a written quotation stating:
- the ELDOVISA service fee;
- any official government charge, shown as a separate line;
- any third-party supplier cost (flights, accommodation, transport, tours);
- the total payable and the currency;
- the scope of work covered.
A quotation is valid for 7 days unless stated otherwise. No contract exists and no charge is made until you accept a quotation in writing.
4.2 Currency and payment
Prices are quoted and charged in US dollars (USD) unless a different currency is agreed in writing. Where your card or bank account is denominated in another currency, your provider's conversion rate and any foreign-transaction fee apply and are outside our control.
Payment is due in full on acceptance of the quotation unless we agree a staged schedule in writing. Work begins once cleared payment is received. Accepted payment methods are stated on your invoice. Card payments are processed by a regulated third-party payment provider; ELDOVISA does not store your full card number.
We will never ask you to send payment to a personal account, nor request your card PIN, CVV by message, or online banking password. If you receive such a request purporting to come from us, do not comply — contact us using the details on this page.
4.3 Charge descriptor
Payments to us appear on your card or bank statement under a descriptor containing ELDOVISA. If you do not recognise a charge, please contact us before raising a dispute with your bank — we can usually resolve it the same day.
5. Official government charges
Many applications carry a fee payable to a government authority. Where we collect this from you, it is passed through at cost and without markup, and shown as a distinct line on your quotation and invoice.
Government charges are set by the authority, not by us. Once paid to an authority they are, in almost every jurisdiction, non-refundable — including where an application is refused. This applies regardless of the outcome and irrespective of any refund you may be entitled to on our own fee.
6. Processing times
We commit to responding to new enquiries within one business day, and to completing our own preparation work within one to three business days of receiving your complete documents.
Government processing time is determined by the relevant authority. Any estimate we provide is the authority's own published guidance and is not a promise by us. Authorities may request further documents, conduct interviews or suspend processing without explanation. We will notify you promptly of any change we become aware of.
We strongly recommend that you do not purchase non-refundable flights before a visa is granted. If you choose to do so, that risk is yours.
7. Cancellation and refunds
Cancellation rights and refund entitlements are set out in full in our Refund & Cancellation Policy, which forms part of these Terms. In summary: our service fee is fully refundable before work begins, partially refundable while work is in progress, and not refundable once an application has been submitted to an authority. Government charges and third-party supplier costs follow the rules of the authority or supplier concerned.
8. Third-party suppliers
Where your arrangements include flights, accommodation, ground transport, tours, experiences or insurance, those services are delivered by independent suppliers. ELDOVISA acts as an intermediary arranging them on your behalf.
Your booking is additionally subject to that supplier's own terms, including their cancellation and amendment rules, which we will make available to you before booking. We select suppliers with care but are not liable for their acts or omissions, for schedule changes, overbooking, service quality or supplier insolvency. Where a supplier fails to perform, we will assist you in pursuing your rights against them.
Travel insurance, where mentioned, is provided by licensed insurers. ELDOVISA does not underwrite, issue or sell insurance and receives no discretionary authority over any policy. You contract directly with the insurer.
9. Liability
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot lawfully be excluded.
Subject to that:
- we are not liable for the refusal, delay, revocation or cancellation of any visa, permit or entry clearance by an authority, where our work was performed correctly;
- we are not liable for refusal of entry at a border, which remains at the discretion of the immigration officer even where a valid visa is held;
- we are not liable for losses arising from inaccurate, incomplete or late information supplied by you;
- we are not liable for indirect or consequential loss, including lost profit, lost opportunity, or the cost of non-refundable travel purchased before a visa was granted;
- our total aggregate liability arising from any engagement is limited to the ELDOVISA service fee you paid for that engagement.
We are not liable for failure to perform caused by events beyond our reasonable control, including changes in immigration law or policy, authority system outages, industrial action, natural disaster, epidemic, civil unrest or armed conflict.
10. Prohibited use
You may not use ELDOVISA services to submit false or fraudulent information; to obtain entry to a country for a purpose you have not disclosed; to facilitate human trafficking, smuggling, forced labour or any form of exploitation; to circumvent a lawful entry ban; or to launder the proceeds of crime. We screen engagements against applicable sanctions requirements and will decline or terminate any engagement we reasonably believe falls into these categories, reporting it to the relevant authority where we are legally obliged to do so.
11. Intellectual property
The ELDOVISA name, logo, website design, written content and checklists are owned by ELDOVISA LLC and protected by applicable intellectual property law. You may view and print material from this site for your own use. You may not reproduce, republish or commercially exploit it without our written permission.
12. Data protection
Visa preparation requires sensitive personal information. How we collect, use, store, share and delete it is set out in our Privacy Policy, which forms part of these Terms. In short: we collect only what is necessary, we share it only with the relevant authority or the supplier fulfilling your booking, and we do not sell personal data.
13. Complaints
If you are unhappy with any part of our service, write to support@eldovisa.my with the subject line “Complaint” and your case reference. We will acknowledge within 2 business days and provide a substantive response within 14 calendar days. If our response does not resolve the matter, you may ask for it to be escalated to a director, who will review the file independently.
14. Changes to these terms
We may update these Terms to reflect changes in our services or in the law. The version in force for your engagement is the version published on the date you accepted your quotation. Material changes are published on this page with a revised “last updated” date. Continued use of our services after a change constitutes acceptance of the revised Terms.
15. Governing law and jurisdiction
These Terms and any dispute arising from them are governed by the laws of the State of New Mexico, United States, and the courts of that jurisdiction have exclusive jurisdiction. Nothing in this clause removes any mandatory consumer protection available to you under the law of your country of residence.
If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force.
